By BEN SERRANO Correspondent BUTUAN City--The Office of the City Prosecutor in Cabadbaran has approved the filing of a case against Agusan del Norte 2nd District Rep. Erlpe John Amante and Cabadbaran Mayor Katrina Marie Mortola for violation of RA 9262, otherwise known as the law on violence against women and children. In a four-page resolution dated Nov. 24, 2016, acting city prosecutor Manuel Tesiorna, Jr. ordered the filing of charges against Amante and Mortola before Regional Trial Court of Cabadbaran, saying “(the) records are very clear that the complainant/respondent Mrs. Judy C. Amante and her children suffered emotional distress because of the illicit sexual relations of the respondents. Hence it falls definitely under the provision of Section 5 (i) of RA 9262.” Judy, Rep. Amante’s wife, filed the complaint for concubinage and violation of the law on violence against women and children against her husband and Mortola on Sept. 27, 2015. The case has been delayed due to the inhibition of prosecutors. In Sept. 20, 2016, Tesiorna dismissed the complaints but Judy filed a motion for reconsideration on Oct. 5, 2016 that resulted in the filing of the case. The complaint for concubinage however was dismissed. Judy’s complaint was used as an election issue against the congressman.
