MINORITY floor leader city Councilor James Judith brought the complaint of residents to the council against a contractor of a condominium project in a subdivision in Barangay Kauswagan for the alleged on-site lapses that risked public safety.

On Wednesday, Judith said the complainants are now set to file charges against the contractor, Carwill Construction.

“The homeowners of the subdivision hence are set to file charges against the condo contractor,” said Judith.

He said the ongoing construction of a condominium could even be stopped if the court proved such lapses were committed.

“Only the court can issue a stoppage order if there was an injury that caused by falling debris,” said Judith adding that could be for reckless imprudence resulting in injuries.

During Monday's regular session, Judith aired the complaints of RER Subdivision residents against Carwill Construction, the contractor of a condominium project of Cebu Landmasters in the said barangay over falling debris.

To validate the report, Judith even shown to the councilors a 45-second raw and unedited video of the actual footage of the situation.

“Makita ninyo na wala gyud gisagad (ang safety nets), mao na mangahulog bale ang mga debris maigo ang naa sa ubos na bahin na dili na teritoryo sa Cebu Landmasters,” the councilor manifested.

The residents also complained about the construction overtime work that usually goes past 10:00 in the evening.

According to Judith, they are requesting to adjust the time of the construction works because they can no longer have a good night's rest due to the noise caused by civil works.

“Whoever is responsible for safety during the incident may be charged,” Judith said.

Yet, during the report, Judith did not mention an incident that anyone had been hit by falling stones or other construction scraps from the condominium being built.

“If the court established that there was had injured person caused by the falling debris, the contractor was found to have violated occupational safety and health standards,” said Judith.

According to Judith, the problem regarding falling debris at the construction site has already been addressed by the barangay months back with the contractor amenable to safety measures and other related compromises set together with the complainants.

However, to the dismay of the residents, the contractor allegedly failed to comply with these agreements and the same predicament recurred.

Judith also pointed out that while the residents have no objection to the construction of the condominium as they regarded it as part of the development of the barangay, their safety should still be given utmost concern and consideration.

Among the safety measures previously agreed upon by the parties was for the contractor to install safety nets covering the entire stretch of the construction area. Seemingly, this was not observed by the contractor jeopardizing the safety of the residents, lamented the councilor.

He said that the matter was now referred to the community of public works chaired by Councilor John Michael L. Seno for appropriate and urgent action.
