Emano appointee still not recognized by Uy’s allies in Talisayan

APPOINTED Municipal Councilor Rico Taray is still not recognized by the majority bloc of the Sangguniang Bayan of Talisayan in the eastern part of Misamis Oriental during its regular session on Wednesday.

Taray attended the session without recognition for the fifth time.

In an interview, Councilor Andres Llagas of the majority bloc claimed that the appointment of Taray did not follow the process when Misamis Oriental Gov. Yevgeny Vincente Emano appointed him to be a municipal councilor.

It was learned Taray was appointed by Emano on July 26 then take his oath of office somewhere in Tagoloan, Misamis Oriental to replace the resigned Councilor, Mylene Gonzales.

Gonzales resigned on June 4, this year. The Sangguniang Bayan of Talisayan declared one position vacant after a couple of days.

Llagas said the governor should follow the process in accordance with Paragraph C of Section 45 of the Philippines Local Government Code because the resigned councilor was an independent candidate during the 2018 Elections.

Llagas interpreted that under section 45 of the Philippine Local Government Code if the resigned member of the Sangguniang Bayan is an independent or does not belong to any political party, the local chief executive will appoint the replacement upon the recommendation of the majority.

Laggas and his group identified allied with the Rep. Juliette Uy of the 2nd District of Misamis Oriental while Rico Taray is affiliated with Emano’s Padayon Pilipino.

For his part, Town Mayor Rommel Maslog said Taray is qualified for the position because the resigned councilor was also a member of the political party.

Maslog said Gonzales was an independent candidate during the filing of her certificate of candidacy as municipal Councilor in the 2018 election.

But she took her oath of office as a member of the political party and officially joined the local lineup as replacement of former vice mayor Carlito Rayon who died during the pre-campaign period sometime in October 2018.

Rayon was running for municipal councilor under Padayon Pilipino in Talisayan.

Emano’s appointment of Taray as a municipal councilor was based on Paragraph B of Section 45 of the Philippine Local Government Code, because he was a bonafide member of the party, Maslog pointed out.
